Done. It correctly showed the representitive and the senators. But I am not sure it went. Particularly the screen of advacacy to send mail to 6 frineds kept on coming up. If I don't receive confirmations to my account, I will send once again. Or I will call them also.

Your case is like me, except I am porting Priority date from my previous approved I-140 Eb3 case. Your new I-140 transferred to Texas Service centre because your employer comes under Texas Service centre. Your residency location also comes under Texas service centre. So you will receive I-485, I-765 and I-131 with SRC numbers. But it may take longer time.
Good thing is Texas Service center is processing I-140 applications in May 2007. Max they are taking 5 months. People are discussing about LUD, it doesn't matter. It seems Texas service centre doing some regular maintenance. If you register your old approved H1s, their LUDs also changing.

I am in NJ and my employer too, and yes 140-485-765 concurrently..and I just checked the 140 file and it was updated 8-12-07...Do you guys think this is related to notices of action??? :confused:

Normally the employer will thread like this. But they wont do anything because if they sue you, they have to spend lot of money then what you have to pay them. Just reply like this.
1. I am ready to face the law suit, I got my attorny and ready to take legal action and I know how to deal with you.
2. I give you this many XX days. Pay me or I am going to refer this case to DOL and DHS.
3. Definitely they will not do anything. Once you refer them to DOL and DHS they are screwed. DHS security will investigate this and if there is any violation of law, this employer can not do any H1 for any one and all their GC process would be in limbo.
Simply they can not afford to take legal action or face DHS. If I were you I would do whatever it takes to recover my money. I wont let them go without hard time.
Be bold and do this.

Right,
looks like USCIS are giving us least priority.They may be thinking we are suppose to file a law suit when Visa are unavailable during July3 to July 16.
Dont know where they put our application?do we get any rfe or rejection?

it is very frustrating that most of the guys whi have filed between July 2nd -July 16 have been waiting either close to 90 or more than 90 days, just for the sake of the DAMN receipt notices.
I have been very patiently waiting for the past 84 days (as i filed mine on July16th) and I see that even folks who filed just during the Aug 10th period are also getting their notices and getting their FP done.
DAMN with USCIS sorting order, as those morons could not even implement a FIFO manner, if they had followed, we would have had our receipts long back.
Once again, HELL with these stupid receipting process.
Hope atleast some of you can understand the pain in the whole friggin process.

did anyone did canada landing having no or expired visa & already used advance parole( i used advance parole for travel to India and my i-94 shows my status as AOS)
I am still not able to decide on whether to give up canada landing or not.
Had spent 6K to do all these and when its time to land........... lot of confusions

Whoever the lawmaker was who came up with the idea of allocating leftover EB4, EB-5 to EB-1 ! What? the least wanted category giving away its quota to highly deserving EB-1 ? How low can their thinking go ?

I applied 485 on July2nd 2007, we never got the FP notice, I called up the USCIS inquiry number, opened two service requests, nothing happened. My lawyer sent a letter asking USCIS to look at our case, that was ignored as well. We finally got an Infopass appointment and went to the office today, after a little bit of confusion, we were told that the most likely cause was that we sent pictures along with our EAD applications and that confused CIS procedures and they missed sending us FP notices.
Cant believe this crappy explanation, but this is what we were told. We were told that usually they call people in for FP and take the pictures and then process the EADs. Anyway, it took all of ten minutes to figure this out and issue us an FP notice, there is no reason they couldnt have done this over the phone...
Good thing though is that not having the FP done does not stop then from processing the Name check and infact my wife's name check has been completed..

Few days ago, I saw this on TV - An American soldier died in Iraq leaving behind a 29 year old Polish wife and 6-month-old US citizen baby. Wife's paper (adjustment of status from K1->GC) was pending for 6 months or so with USCIS. When USCIS came to know about the death of that soldier (US citizen and I do not know how they came to know about it), they issued deportation order for his wife. Reason being, primary applicant is no more in this world so his dependent's application is null and void. She has been running from door to door with a baby in one arm and death letter of her husband with deportation order in the other arm. There is no one to listen to her. She lost her husband; she is going to lose her house and ability to stay in this country.
I absolutely hate to say this but Mehul, I think your wife will be better off in her home country. Please weight this option as well. My prayers are with you.

hope that means they are willing to talk about giving EAD. If we get EAD all the lawsuits will be withdrawn. The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. Then can easily accomodate the EAD for july filers. It all depends upon the pressure exerted on USCIS and DOS
Pitha -- the law says quite clearly that AOS applications cannot be filed if visa numbers are not available. Which is why IV was trying to get in an amendment that says AOS can be filed even when visa numbers are not available.
USCIS would fight a change in this tooth and nail -- cos as the Ombudsman has reported again and again in his annual reports -- when they spend a huge amount of time churning out EADs and APs, actual adjudications of green cards fall behind. Then there are the people (incl Ombudsman) who say that such interim benefits (EAD AP) should not be granted to such large numbers of people without security checks etc.
My guess is that this is precisely why USCIS didn't want the all current situation. They don't want to be stuck with 700K applications which have no hope of getting a greencard for years upon years, while they churn out EADs and APs for all those years.
Of course, one fix would be to increase the EAD time period to 3 yrs. Something they have been unwilling to do.

I applied on June 12th, received 13th and notice date June 16th. I see some approvals for those who applied in that time frame and also some pending for those who have receipt date in May. Is the approvals being done randomly?

First 3 year extention filled on July 10th 2008 .
Approval notice sent Email : Aug 27th 2008.

I 140 Appoval date : July 31st 2008.

My NJ DL was expiring in Sep 2008 . My visa was expiring in Nov 2008. ( Stamp and I 797 ).
I went to NJ DMV and they renewd my DL till Nov + 90 days = Feb 2009.
it was smooth process and took 1 hour to get it renew.
